These Terms & Conditions (“Terms”) govern your access to and use of the website, communications, and travel services provided by Secrets Holidays (“we”, “us”, “our”). By using our website or booking a service, you agree to be bound by these Terms and our Privacy Policy.

2) Eligibility

You must be at least 18 years old and capable of entering into a binding contract. When booking on behalf of others, you represent that you have authority to accept these Terms for each traveler.

3) Our Role

We act as a travel organizer/agent for third-party suppliers (airlines, hotels, DMCs, transport, activities, visa facilitators, insurance providers, etc.). Your contract for individual components may be with the relevant supplier(s). Supplier terms (including fare rules and cancellation policies) apply in addition to these Terms.

4) Quotes, Bookings & Contract Formation

  • Validity: Quotes are subject to availability and may change without notice until payment and confirmation.
  • Confirmation: A booking is confirmed only when you receive a written confirmation/voucher from us.
  • Traveler details: You are responsible for providing accurate names (as per passport/ID), dates, and preferences. Name/date changes may incur fees or be unavailable.
  • Errors/Omissions: We reserve the right to correct obvious pricing or description errors and either (a) give you the option to proceed at the correct price/terms or (b) cancel with a refund of amounts paid to us for the affected component.

5) Prices, Inclusions & Exclusions

  • Dynamic pricing: Airfares, taxes, fuel surcharges, and exchange rates are dynamic and can change until ticketing/issue.
  • Inclusions: Only items explicitly listed in your itinerary/voucher.
  • Exclusions: Visa fees, PCR/vaccinations, travel insurance, resort/city taxes, tips, optional tours, early check-in/late check-out, personal expenses, unless stated otherwise.
  • Local charges: Some destinations levy mandatory local taxes/fees payable directly at hotel/attraction.

6) Payments, Deposits & Chargebacks

  • Deposit: A non-refundable deposit of [DEPOSIT % or ₹ AMOUNT] may be required to secure services.
  • Balance due: Full payment is due by [BALANCE DUE DATE or “as advised”]. Non-payment may lead to automatic cancellation with applicable supplier penalties.
  • Methods: We accept the payment methods we notify (e.g., bank transfer, UPI, card). Convenience fees, if any, will be disclosed.
  • Chargebacks: You agree to contact us to resolve disputes before initiating a chargeback. We may contest unjustified chargebacks and recover costs.

7) Changes & Cancellations by You

Change/cancellation requests must be sent in writing to us. Fees depend on supplier rules plus our service fee (if applicable). Certain fares/rates are strictly non-refundable and non-changeable. No-shows typically forfeit 100% of the price.

8) Changes & Cancellations by Suppliers/Us

Suppliers may modify schedules, routes, or services. If a significant change or cancellation occurs, we will assist with alternatives or refunds as per supplier policy. Our liability is limited to amounts received by us for the affected component, subject to Section 19.

9) Refunds

Refund eligibility and timelines are governed by supplier rules. Where a refund is approved, allow [7–21] business days after we receive the refund from the supplier to process it to your original payment method, net of non-refundable amounts and fees.

10) Visas, Passports & Travel Documents

You are responsible for valid passports, visas, transit visas, health documents, and compliance with destination/airline requirements. We can assist with guidance, but final responsibility rests with the traveler. Entry is at the discretion of border authorities.

11) Health, Safety & Insurance

Check health advisories, vaccination requirements, and local conditions before travel. We strongly recommend comprehensive travel insurance covering medical, trip cancellation/interruption, baggage, and personal liability. Supplier/foreign policies may apply.

12) Flights, Baggage & Check-in

  • Arrive at airports/stations with sufficient time. Reconfirm flights and monitor schedule changes.
  • Baggage allowances, special items, and fees are per airline. Lost/delayed baggage claims lie with the carrier.
  • Overbooking, rerouting, delays, and denied boarding are governed by carrier rules and applicable law.

13) Accommodation & Local Services

  • Room types/bed configurations are as per hotel policies; special requests are subject to availability.
  • Standard check-in/check-out times apply; early check-in/late check-out may incur extra charges.
  • City/resort fees, security deposits, and incidental charges are payable directly by guests.

14) Special Assistance & Dietary Requests

Please inform us in writing of any mobility, medical, or dietary needs at the time of enquiry/booking. We will pass requests to suppliers but cannot guarantee fulfillment.

15) Conduct

You must comply with local laws, supplier policies, and reasonable instructions of guides/crew. We may refuse service or terminate arrangements (without refund) if your behavior poses safety risks, causes distress, or damages property.

16) Website Use & Intellectual Property

Website content, logos, and materials are owned by or licensed to us. You may not copy, distribute, or create derivative works without permission. Do not use the site for unlawful activities, scraping, or security breaches.

17) User Content & Reviews

If you submit reviews, photos, or content, you grant us a non-exclusive, royalty-free, worldwide license to use and display such content for marketing and service improvement. You are responsible for ensuring you have rights to share the content.

18) Privacy

Our data practices are described in our Privacy Policy, including cookies, marketing communications, and rights under applicable laws (e.g., India’s DPDP Act, 2023).

19) Liability, Limitations & Indemnity

  • Third-party services: We are not liable for acts/omissions of independent suppliers or events beyond our control.
  • Limit of liability: To the maximum extent permitted by law, our total liability arising out of or in connection with your booking shall not exceed the total service fees paid to Secrets Holidays for the affected booking.
  • No indirect damages: We are not liable for loss of enjoyment, consequential, incidental, punitive, or special damages.
  • Indemnity: You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your breach of these Terms or violation of laws/third-party rights.

20) Force Majeure

We are not responsible for failure or delay due to events beyond reasonable control, including but not limited to acts of God, pandemics/epidemics, natural disasters, war, terrorism, labor disputes, government orders, power/IT outages, or supplier insolvency.

21) Promotions, Vouchers & Credits

Promotional offers are time-bound and subject to specific terms. Vouchers/credits are non-transferable, cannot be exchanged for cash, and expire as stated.

22) Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Courts at Noida, Uttar Pradesh shall have exclusive jurisdiction. You agree to first attempt amicable resolution by contacting us. (If arbitration is preferred, update this clause accordingly.)

23) Changes to Terms

We may update these Terms from time to time. The “Last updated” date reflects the latest revision. Continued use of our services constitutes acceptance of the updated Terms.

24) Severability, Waiver, Assignment, Entire Agreement

If any provision is held invalid, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights without our consent. These Terms, together with your itinerary/voucher and supplier terms, constitute the entire agreement.
